NO PENSION PAYMENT DURING MONTH END !




THOUGH PENSION PAYMENT IS DUE ON 1ST OF EVERY MONTH, YOU ARE RECEIVING
PENSION ON THE LAST DAY OR SO OF THE PREVIOUS MONTH.  OF COURSE, SOME
OF YOU MAY BE GETTING PENSION LATE BECAUSE OF YOUR OPTION TO RECEIVE
PENSION PAYMENTS BY CHEQUE.

WE UNDERSTAND THAT NO PENSION WILL BE RELEASED DURING THE CLOSING DAYS OF MARCH 2012. 
RELEASE OF PENSION THIS MONTH WOULD MEAN PAYMENT OF 13 MONTHLY PAYMENTS OF PENSION DURING
THE CURRENT FINANCIAL YEAR.

TO AVOID THIS SITUATION, LIC HAS DECIDED TO RELEASE PENSION ONLY ON 3RD OF APRIL
2012, 1ST AND 2ND OF APRIL 2012 BEING BANK HOLIDAYS.

LEGAL BATTLE: CRUCIAL MONTHS AHEAD !


confusion...
I’m receiving anxious enquiries from LIC pensioners…
They all want to know
what’s  the present position of the petitions
pending in the High Court
and the Supreme Court.

I try to explain.  But all my pleadings are of no avail. 
Our pensioner-brethrens are all restless.
They want to have immediate result.  But no significant
result is forthcoming….

The latest position is this.

THERE IS A CONTEMPT PETITION PENDING IN RAJASTHAN HIGH COURT.
But, as long as the whole matter is pending in Supreme Court, we need not expect any significant development to take place in the High Court.


 

NEXT COMES THE CONTEMPT PETITION FILED IN THE SUPREME COURT.
It is understood, this contempt petition emanates from the fact that LIC has failed to deposit the amount Court had asked them to pay or deposit to the Court Registry.  The court itself will interpret its own orders in this matter.  Let us wait and see.

The all important legal battle will be waged in the Court in the case of Special Leave Petition filed by LIC.  It was last listed on 7th February 2012 and there are no further developments.

Let us wait patiently.  There will be clear developments in this matter within a couple of months.

.....THE BALL IS IN THE SUPREME COURT !


LIFE INSURANCE CORPORATION OF INDIA is an autonomous body.


Supreme Court

The Board of Life Insurance Corporation of India has passed a Resolution proposing certain changes in the Pension Rules. It has also resolved that these changes would be implemented with the approval of Government of India.

Government never approved these proposals.

Rajasthan High Court was moved.

It was argued, Government could interfere with a decision of the Corporation.  But it chose not to interfere.  No directive was ever given against the Board resolution.

LIC being an autonomous body, it could have implemented its own Resolution. 

But there were clear hurdles.  Pension Scheme was implemented in the Corporation through a Government Notification dated 28-6-1995.  Can the Corporation bring about changes on its own now without a Notification being issued by Government of India (GOI). 

Rajasthan High Court order would suggest, LIC could implement its Board Resolution.  But LIC thinks that Government approval is required.

Government of India has joined the issue in the Supreme Court.  Government counsel will appear in the Supreme Court today for the first time.

Now let us wait for Supreme Court developments !

POSTPONED !

REPORTS REACHING US SHOW THAT……

·       SUPREME COURT CCP NO. 82-83/2012 IS POSTPONED AND POSTED TO 19 MAR 2012.

·      RAJASTHAN HIGH COURT CONTEMPT PETITION IS POSTED TO 27 MAR 2012.

·      SUPREME COURT SPECIAL LEAVE PETITION DATE REMAINS AS 16 MAR 2012.

Contempt Petition in Supreme Court

SUPREME COURT will take up Contempt Petition today.  We will wait to see what transpires in the Court.



A version of the earlier Supreme Court proceedings is as given below:-

 

Sri Salve requested the Bench to see that Union of India advises LIC to implement the orders.


The Bench asked Sri Salve the exact amount.


Sri Salve mentioned that the figure is not readily available.


The Bench then asked him the amount stated in LIC Board Resolution.


When Sri Salve replied it was around Rs 52 crores, Bench immediately ordered Sri Salve to ensure LIC deposits that amount within 3 weeks from today in Jaipur HC.


SC Bench then told the parties that SLP will be pursued after expiry of that period.




As per this version, Supreme Court has asked LIC to deposit a minimum of Rs.52 crores in the Court whereas LIC has deposited only Rs.4.35 lakhs.

The order finally passed by the Bench, however, did  not specify the exact amount to be deposited.  It merely notes that the “amount due to the employees” should be deposited.

It is hoped we will get some clarity in this matter.
